HFW and DIFCIA Host Seminar on Law & Jurisdiction in Insurance Disputes in the UAE

The DIFC Insurance Association (DIFCIA), in partnership with HFW, recently hosted a breakfast seminar in Dubai focused on Law & Jurisdiction in Insurance Disputes in the UAE: Where are we now?

The session brought together insurance professionals from across the market for a practical discussion on the legal process surrounding insurance claims in the UAE, recent developments affecting law and jurisdiction, and the steps organisations can take to help minimise risk and uncertainty when disputes arise.

HFW’s Samuel Walkerly, Luke Garrett and Salma Khouaja led the discussion, sharing legal and practical insight across a number of key areas currently relevant to insurers, reinsurers, brokers and other market participants.

Topics covered included recent developments from the UAE Onshore Courts and Offshore Courts, including the DIFC and ADGM Courts, as well as the Sanadak and Insurance Dispute Resolution Committee process.

The speakers also explored the role and process of the Conflicts of Jurisdiction Tribunal (CJT), including the potential challenges that can arise where questions of jurisdiction exist between different courts.

The session considered whether arbitration remains an effective dispute resolution mechanism for insurance claims, together with some of the practical and legal considerations surrounding governing law in insurance contracts.

Throughout the seminar, attendees had the opportunity to raise questions and discuss how these issues can affect claims, policy interpretation and dispute resolution in practice.

Events such as this form an important part of DIFCIA’s wider commitment to supporting knowledge-sharing, professional development and engagement across the DIFC insurance community, while giving members access to practical expertise on issues directly affecting the market.

DIFCIA would like to thank HFW, Samuel Walkerly, Luke Garrett and Salma Khouaja for sharing their expertise, together with the wider HFW team whose support helped bring the event together.

We would also like to thank everyone who joined us and contributed to the discussion
